The Dabangg 2 star has been instructed to appear in court on December 27 along with Bandra Police Inspector Abhay Shastri in connection with a 2002 hit-and-run case.
Santosh Daundkar - who issued the summons - told Mid Day he met Shastri on December 24 and asked the police officer whether he had served the summons on Khan yet.
Daundkar claimed that, when Shastri said Khan was not in Mumbai, Daundkar "informed him that at the time he was shooting in Mehboob Studio".
"Shastri was furious and mocked me, calling me a 'good detective'," Daundkar said.
"He told me that this [serving summons] was their job, and he would satisfy the court. He added that his staff was busy in Christmas bandobast [preparations]."
Daundkar has alleged that Mumbai police faked documents and tampered with evidence in the case.
Khan was arrested on September 28, 2002 after he allegedly drove his car into a bakery in Bandra and ran over people sleeping on the pavement, killing one person and injuring three.
It was previously reported that a film inspired by the actor's controversies and brushes with the law would be made.
