Contract

Hello fellow Virgin Media customers

I would like to ask you all a question.

Have any of you who have taken on an additional service(s) since the company became Virgin media received a new written contract or a letter of written terms of what the new services are you have agreed to take on ?

To new customers did you receive a contract stating what service(s) you would be receiving ?

I am emphasising the RECEIVING of a CONTRACT in this thread.

I was always under the impression that when taking out, even an additional service, you should by law receive a written summary of exactly what it is now are now receiving and a new DD mandate giving them permission to take out the new sum of money. By them i mean any company not strictly VM in this sense.

My point is that with new new contract or additional summary report you have no proof as to what you agreed to take, you have no legal document to state this fact, and this i believed is why you always had to receive new written terms, you sign it they sign it and it becomes the new legal terms & conditions of what you agree to.

Virgin Media rep(s) are stating existing customers do not get issued new contracts however my father absolutely must have a contract or written terms. The CS a couple of days ago said she although they didn't do it she would sed out a summary of what we have taken ourselves with the additional services .. We received the standard booklet/letter we got in the first place !

when i got all 3 serviices from then telewest they posted a contract out which i didnt even sign and was never sent another one,but i agree you should be sent a new contract or you could just cancell six months after they wouldnt have a leg to stand on.

CONTRACT An agreement, written or oral, between two or more parties where one party undertakes to do something in return for something else. All systems of law have developed formulae to determine when a legal contract is formed. COMMON LAW focuses on an offer by one party, which is converted into a contract when accepted by another. In addition, the law requires that the parties should intend to be legally bound, thus distinguishing a contract from a GENTLEMEN'S AGREEMENT. The terms of the contract should be reasonably certain and the party seeking to rely on it must be able to show it has given CONSIDERATION. if all of these criteria are satisfied, you can enforce the contract. If one or more is not, you cannot.
