penalty form- need help

Hi

I have received a letter from speeding, 323mph, over 3mph. I don't know what to do with the form. I filled in with my name and address.

The problem is I lost my driving licence last week. But I have got counterpart form with me. My licence is on the way, I have got 28 days notice issue date (4/11/09).

They need driving licence, it said, if your licence unavailable, i have to contact the camera processing unit.

I cannot use the phone cos I'm deaf. I can't find emails anywhere at all, even on the safecam.com don't use email at all.

I also don't understand about Speed choice workshop, do I have to attend or not?

I am really stressed at the moment and panicking. I'm so confused. :-(

your new license should be with you in 28 days id imagine. you could send in the paper counterpart and if they need your plastic bit then they will contact ou, this might give you some stalling time...

speed choice - if its what i think it is (go on a speed awareness course and you dont get points?), its up to you to choose points on your license or take the course

Thank for reply quickly.

On the form said, both part if it is a DVLA card and counterpart licence. I'm not sure what that means.

I think I'll send it to them anyway.

Edit: Unfortunately, though, if you've been given a fixed penalty, that page doesn't seem to apply:

Yes, they gave me fixed penalty of £60.

It looks reasonably straightforward then. You need to fill in page 3 of the document and you can forget about the rest of it.

However, as you say, the form says that if your licence is lost you must contact the Camera Processing Unit office before applying for the fixed penalty, so I guess you'd better write them a brief letter explaining the situation. You say that you have the paper part of your licence (the counterpart) and it may be that's what they want anyway so that they can show the penalty points on it.

Don't worry; it's a nuisance but not the end of the world!

PS: I'm assuming you agree that you were the driver and that you're accepting the penalty. Maybe you aren't, though?

The Association of Chief Police Officers have a speeding penalty formula guidance, set out below. I would suggest that as you were only 3 mph over the limit you should ask why they were not following their own Association's guidance. Assuming, that is, you were caught by speed camera. What follows is extracted from www.speedlimit.org.uk:

These guidelines set out the minimum figures at which a Fixed Penalty Notice and a Court Summons would normally be considered appropriate for a speeding offence, if there are no other aggravating circumstances. The minimum figure for a FPN is the posted limit + 10% + 2 mph. These figures are shown in the table below:

Bear in mind that exceeding a speed limit by any amount whatsoever is an absolute offence, and a police officer is fully entitled to charge a driver for doing, say, 31 in a 30 limit outside a school at closing time, or in a busy High Street.

However, since a speed camera or Talivan is unable to make any judgment as to aggravating circumstances, automated FPNs issued by these means should not normally fall below the Fixed Penalty level set by the formula. In the past, many Gatsos had thresholds set much higher - in the Metropolitan Police area they were originally set at 43 mph in 30 limits - but in recent years most have been brought down to the minimum ACPO figures. However, I have yet to see a case where someone has received an FPN from a camera or Talivan for a speed below these guidelines - although obviously this can be done by a police officer in person.

Given that most car speedometers overread by up to 10%, if you drive past a speed camera at up to an indicated 5 mph above the posted limit, you will normally be OK. On the motorway, an indicated 80 mph should not cause any problems.
