Advice Please re Bailiffs
Hi ya
I wonder if anyone can help. My partner has been paying a bailiff under an agreement that the debt will be paid up by end of November. Unfortunately my partner went to prison 2 weeks ago so can no longer pay for the debt. I am 29 weeks pregnant and on Employment and Support Allowance receiving £102.00 a fortnight. I have rang the Bailiff and he has said that i have to pay the debt there is £209.00 left on it and he wants half end of November and the remaining end of December and i just dont have it. Is there anything i can do about this. The debt is for Council Tax. Thanks for your time. April |

its your partner who owes the money not you, so the baliff should harass him shouldnt he? i dont how the baliff is meant to get the money but thats not your problem...

Seek advice from CAB to put your mind at rest. You shouldn't be responsible for your partners debts, so long as they are in his name only.
Edit, seen your post above, I'd definitely get to the CAB asap. |

Yes thats what i thought, i was going to go today but thought i could speak to the Bailiff and sort it out with him but to no avail, i think i best get myself down there tomorrow. Thank you so much for your help.

Your partner is no longer a resident at your address. Therefore has no right to entry. The bailiff knows this and is trying it on.

If it is for council tax then it will be a court appointed bailiff not just some thug who can threaten you for money - still serious but they will have to abide by the law.
Get to the CAB and ask them what you need to do to go back to the court and renegotiate the repayments, the current arrangement will be deemed to have been negotiated on behalf of you and your partner and as such will still stand unless you go back to the court. Good luck, sounds like a pretty stressful time for you. |

Sorry to hear you are having a rough time. One thing that might help is this:- I had a county court judgement against me... long time ago, and the Court Appointed Baliff turned up at my house and said I had to let him in etc. I actually phoned the court where my debt was and spoke to a court clerk (nice lady) and she told me... that even if a court appointed baliff turns up legally you are not obliged to let him in. So I told the the baliff that... and he said yes you are etc. etc. But I then said if he didn't go away I would call the police (coz I am woman on my own etc) and he went away.... shortly after that I moved but he didn't come back before I moved. Now, some people on here have said that is not correct and if they are a court baliff you have to let them in. So I would go to your CAB and ask them, coz obviously DO NOT LET them in and also dont leave any windows open as apparently they can legally can access that way... but they cant break down the door even if they say they can. Dont use your maternity grant, go to CAB hun and if they turn up DONT LET THEM IN and if you do phone the police so that they are present.... but it shouldn't come to that. You are 29 weeks pregnant and vulnerable woman.... to be honest they should be ashamed of themselves... they should be prepared to except £2.00 a week, if it goes back to the court that its what the court would accept I think.

As others have said contact CAB. Also worth a try is your local council as its a council tax bill. If you tell them the outstanding amount (which the should know) and explain your partner is now in custody also your are pregnant and events are distressing you they might sort it out so you can pay weekly a small amount esp as you have paid most of it. Also, if the bailiff hasn't already entered the property before, always ensure your windows and doors are closed/locked and speak to them from the upstairs window. |

I have had dealings with the bailiffs re council tax. This link will tell you everything you need to know
http://www.nationaldebtline.co.uk/en...nd_council_tax I eventually wrote to my council to take the debt back, which they did and I am now paying them. edit: If the bailiff has not been in your house, don't let them in. They have no right to enter then. The above link has all the info. edit #2 phone the national debtline too, they were very helpful, much more than the CAB. |

I don't want to seem harsh, but taking on a dog while you are heavily pregnant and in debt with a court case pending for you OH is a little fool hardy. Normally I really try not to be judgemental, but increasing your expenditure at a time like this is just plane daft. |
