A lawsuit filed by Battle One Productions at LA County Superior Court accuses Allen and his Boxing Cat production company of basing the motorcycle gang movie on a script they pitched to him in 1999.
The production company wants at least $25,000 (£15,700) in damages, reports TMZ.
The movie went straight to the top of the UK box office on its release last April, taking £1.7 million in its first weekend.
