Depp is to take on the role of Nick Charles in the film, which will retain the period setting of the first version made in 1934.
It will be based on the famous Dashiell Hammett novel which sees detective couple Nick and Norah investigate a murder in a family of eccentrics.
According to The Hollywood Reporter, Stahl is now attached to the project.
He has previously written for the comedy series ALF and Twin Peaks.
In October, Depp was reportedly keen on bringing Pirates of the Caribbean 4 director Rob Marshall on board the project.
The 1934 film of the same name spawned six more movies and a television series.
