Yesterday, Warner Bros urged the courts to reject a request by tattoo artist S. Victor Whitmill to delay the film's release on the grounds of copyright infringement.
Whitmill, who created Tyson's infamous face art, took issue with a scene in which Ed Helms's character wakes up after a night out to discover he got a similar tattoo of his own.
"We are very gratified by the Court's decision which will allow the highly anticipated film The Hangover Part II to be released on schedule this week around the world," Warner Bros said in a statement.
"[The Plaintiff's] failed attempt to enjoin The Hangover Part II in order to try and extract a massive settlement payment from Warner Bros was highly inappropriate and unwarranted," they continued.
Warner Bros argued that it had reproduced a similar tattoo as a 'fair use of parody', due to Tyson himself making a cameo appearance in the film.
The Hangover Part II will be released in cinemas on May 26.
