The actress had signed on to play lawyer Linda Kenney Baden in the film but has had to pull out due to a herniated disc, reports Deadline.
The HBO Films project has delayed production, with director David Mamet looking to recast the part.
Midler's character is the lawyer that represented Spector during his murder trial. Al Pacino will play the music producer.
The film is expected to be released in 2012, and will be produced by Oscar-winning filmmaker Barry Levinson.
Bette Midler described talent shows such as American Idol and The X Factor as "bland" last year.
