The man was reportedly filmed running away from Sacha Baron Cohen's character Borat in New York City.
According to the BBC, the legal action is seeking unspecified damages for using the man's likeness without consent - and is also seeking compensation for emotional damage.
The lawsuit is one of many to have been filed against Fox for the controversial film.
A spokesman for the production company said that the allegations were "completely without merit".
