The rockers had planned to stage an impromptu gig at New York's Washington Park, but a blunder with administration meant they did not have the appropriate permit.
The New York Police Department told the band that they would face a night in jail if they went ahead and played their instuments, according to MTV.
However, the group decided to continue with their performance in support of new album Folie a Deux, substituting air guitars for the real deal and leading the crowd in a sing-a-long.
"I'm kind of bummed by all that, to be honest," said singer Patrick Stump. "That was going to be awesome.
"Those cops back there - and I have no problem with the cops, trust me - but those cops were like the Grinch. They just took all the presents."
