The group will continue to make music and wished the label "every success in the future".
In a statement on the band's MySpace, the four-piece said: "Whilst it may appear that we've been quiet of late, behind the scenes that has been far from the truth. We have recently parted company with Fiction Records and we wish them every success in the future.
"As you know, all that matters is the music, and we're already in the studio demoing for the next album."
Two new tracks, 'Rhapsody' and 'Unsung', are now available on the group's official MySpace and Facebook sites.
The Delays third album Everything's The Rush charted at number 26 last year. It featured the singles 'Hooray' and 'Keep It Simple'.
