A Toronto judge has approved a request from the former Oasis guitarist to read a victim impact statement before 48-year-old Pickering building contractor Daniel Sullivan is sentenced, the Toronto Star reports.
Sullivan's defence lawyer had asked Ontario Justice Richard Schneider to reject Gallagher's request and said that the musician should not "control the proceedings", adding that he and his family had "suffered significant emotional distress".
He also claimed that Sullivan had done the correct thing in pleading guilty to the charge last November and claimed that the incident was like an "albatross round his neck".
The court adjourned to pick a date when Gallagher is able to appear.
Gallagher broke and dislodged three ribs in the incident, with his band forced to cancel a number of subsequent live dates.
