According to Billboard, the singer claims that Crist used Byrne's band Talking Heads' 1985 track 'Road To Nowhere' without permission or a licence.
Crist reportedly used the song in an online ad against former election opponent Marco Rubio. Byrne is seeking $1m (£697,593) in the suit filed on Monday.
Byrne said that the legal action "is not about politics... It's about copyright and about the fact that it does imply that I would have licenced it and endorsed him and whatever he stands for".
The $1m in damages Byrne is seeking is based on previous offers he has received to use the song in commercials, according to the songwriter's attorney Lawrence Iser.
