A lawsuit filed to Los Angeles Superior Court states that "substantial excerpts" from their tracks 'Best of You' and 'Free Me' soundtracked advertisements for upcoming animated series Wolverine and the X-Men.
Both tracks are taken from 2005's In Your Honour LP.
The lawsuit adds that the song samples "were copied directly from the Foo Fighters' sound recordings of those two songs".
The band are seeking unspecified damages, attorney fees and an injunction preventing Marvel from using the songs again.
Dave Grohl's rockers won two Brit Awards on Wednesday for Best International Group and Best International Album.
