Ellard demanded a special 007 clause in the group's contract when they signed their deal with Epic UK, a division of Sony BMG.
"It's actually written into our record contract with Sony that Pete will be released from the deal if he gets offered the part of 007," frontman Roy Stride told the Daily Record. "He insisted on adding the Bond clause, but we all agreed that we wouldn't sign unless Sony adhered to it.
"They could not believe it. They started laughing when we told them and said to Pete that it was crazy as he would never be the next action star, but Pete was adamant it should be added."
"Even if he has zero chance of landing the role there are obviously some people who think he's in with a chance," Stride continued. "If you look on My Space, there is a fansite dedicated to making Pete the next Bond - it would mean we would lose our drummer though."
The band, who are best known for the songs 'She's So Lovely' and 'Elvis Ain't Dead', are working on their second album during their current tour of the UK.
