Peter Bright was stopped by the police on the road at Long Stratton, Norfolk in May after a night out drinking, Rex Features reports.
While his breathalyser test showed that he was 42mg over the legal limit, his mode of transportation meant that he was not covered by current drink-drive laws.
Prosecutor Richard Paterson told Norwich magistrates: "The offence falls outside the normal drink drive laws and that leaves us with a very old provision from 1872, which is part of the Licensing Act."
The section from the act, much of which has been superseded, is aimed at those caught drunk in charge of a carriage, steam engine, horse or cow.
Bright was fined £50 plus a £15 victim surcharge for the offence.
