After an audio recording of her having sex was played in court, Caroline Cartwright, of Concord, Washington, Tyne and Wear, claimed that had she tried to lessen the disruption by putting a pillow over her face.
At Newcastle Crown Court, Judge Beatrice Bolton said that despite admitting the Asbo breach on April 18, 22 and 26, Cartwright will not be jailed when she is sentenced on January 18, The Sun reports.
Judge Bolton said: "I'm certainly not going to pass an immediate custodial sentence but I am going to order a pre-sentence report. This is not the usual sort of anti-social behaviour.
"The reason why I am asking for a pre-sentence report is because it is such an unusual case and this is the first breach. If it were to be a custodial sentence it would be suspended, I think, at this stage."
Neighbour Rachel O'Connor had described the sounds of Cartwright, 48, and her husband having sex as "a lot of moaning and groaning and screaming as if in pain".
