The package artwork for the 'Harry Popper' brand shows a purple, glasses-wearing condom twirling a wand with its tongue extended.
"The image of my client is in danger," a lawyer representing Warner Bros reportedly said.
'Harry Popper' condoms have allegedly been on sale in Switzerland since 2006.
The latest Potter movie, part one of The Deathly Hallows, is due to open in cinemas this November.
