Niles Gammons from Ohio was initially apprehended by a police officer at 1.08am for drunk driving, according to The Smoking Gun.
The man was then released before the clocks went back one hour at 2am.
At 1.08am, one hour after he was arrested the first time, Gammons almost hit the patrol car of the same officer who booked him earlier.
The sergeant arrested him again for drunk driving.
Gammons had claimed, according to the police report, that his friend refused to take him home and that he "was afraid of getting arrested for public intoxication so he decided to drive".
