Part of her probation required her to not drink for 90 days, causing Los Angeles County Superior Court judge Daviann Mitchell to sentence her for the breach.
Rodriguez has been told she must start the sentence on Christmas Eve and she will not be allowed home confinement or an early release from jail.
The actress' probation violation dates back to a case in 2004 where she pleaded 'no contest' to three traffic offences.
She was also sentenced to 60 days in prison for another probation violation in 2006, but due to overcrowding she was free to go after less than five hours.
