Darryn Walker, 35, is charged under the Obscene Publications Act, which was used when Penguin was prosecuted for D.H. Lawrence book 'Lady Chatterley's Lover'.
The charge claims that the civil servant published a story called Girls (Scream) Aloud online.
Walker, of Westoe, will appear at Newcastle Crown Court in the coming weeks, having been granted bail at an earlier court appearance.
Police began investigating after receiving a complaint from the Internet Watchdog Foundation.
