Hayden Panettiere's father's arraignment on a misdemeanor battery charge has been postponed.

Alan Panettiere will remain on $50,000 bail until December 11 after his lawyers were unable to reach an agreement with prosecutors.

The Heroes actress's dad was arrested in August for allegedly striking his wife Lesley after visiting Eva Longoria's Hollywood eatery Beso.

As part of the arraignment agreement, Lesley was given a protective order, which means Alan can "not harass, strike, threaten, assault [sexually or otherwise], follow, stalk [or] molest" her.

He also agreed not to "destroy or damage real property" and hand over any licensed handguns.

Deputy district attorney Kevin Liu told E!: "It's not standard but it's not unusual. He's not getting any special treatment."

Alan and Lesley attended today's hearing in Beverly Hills, but Hayden was not present.
