Adam Rothberg, of New York publishers Simon & Schuster, said that the rapper's take on fatherhood was due in 2003 and that the manuscript never arrived.
The company are seeking the return of a $61,000 (£44,000) advance plus interest in the lawsuit filed on March 5, reports PA.
Hammer apparently signed a contract in 2002 under his real name Stanley Kirk Burrell for the book titled Enemies Of The Father: Messages From The Heart On Being A Family Man.
The rapper, who lives in California with his wife and five children, recently signed to star in a new A&E show called Hammertime. The reality series aims to give viewers an "unprecedented look behind his larger-than-life personality and into his life as a devoted husband, father and business entrepreneur".
