Mark Geragos will move to have the case against the singer dismissed if the photos prove to have been released by police error, E! reports.
"The leaks can form the basis for a motion to dismiss the case in regards to outrageous governmental misconduct," the lawyer said.
In addition to setting a preliminary hearing date of May 28, Judge Patricia Schnegg ordered that the $1.4 million worth of jewellery that police took from Rihanna the night of Brown's arrest as evidence be returned to her.
The 'Umbrella' singer's attorney also said that they have not been informed if she will be called to testify in the case, but indicated that she would cooperate if asked.
