The celebrity photographer was sued by B2Pro Lighting in December 2008, who claimed that she owed $392,036 (£280,363) for rental services, damaged equipment and failure to deliver enough business.
A judge dismissed a portion of the lawsuit last month, but it is understood that the lighting company are still owed $189,170 (£135,392).
B2Pro's lawyer told the New York Post: "We haven't filed anything yet, but we are doing our due diligence.
"We're in touch with Annie's people and they are co-operating, so hopefully it won't come to that."
Leibovitz reportedly makes $2 million a year from Vanity Fair.
