The actor, who plays Michael Westen in the US spy drama, was reportedly pulled over by officers in Miami on July 12 when he swerved his car in order to avoid hitting the police vehicle from behind.
According to his arrest report, the police officer alleged that Donovan's eyes appeared bloodshot and watery. He was later arrested for failing an on-the-spot sobriety test after allegedly refusing to take a breathalyser test.
Donovan, 41, who recently co-starred with Angelina Jolie in Changeling, was released on a $1,000 (£605) bail.
Representatives for the star have yet to comment.
