The actress, who plays Lily van der Woodsen in the CW drama, had accused Daniel Giersch of "alarmingly harassing and scary" behaviour and claimed that her babysitter quit as a result of the alleged threats.
"It is clear that Daniel has begun to follow me, my mother, my nanny and he shows up unexpectedly to threaten and scare us," she said in court papers.
The order requires Giersch to stay at least 100 yards away from Rutherford and their two children until October 15, when a court hearing will be scheduled.
However, an attorney for Giersch has called the allegations "fabricated accusations" and insisted that Giersch will "remain focused on co-parenting both of their children".
He added that Giersch would not be making any personal statements "in order to continue to protect the children's need for privacy and well-being".
Rutherford filed for divorce from the businessman in January after two years of marriage.
