The estranged couple, who split in June, are scheduled to meet in court tomorrow to discuss their finances.
Kate has accused Jon of withdrawing more than $200,000 (£126,230) from their joint account, leaving her incapable of paying the family's bills.
He has denied the allegations.
Speaking to E! News, an attorney for Jon said: "We have a truce. Neither side will be commenting until after the hearing."
Kate's lawyer previously revealed that the hearing was called to discuss "economic issues". Kate recently filed for temporary spousal and child support from Jon.
Last week, the couple called a truce in order to celebrate their twin daughters' 9th birthday together at the family home in Pennsylvania.
