A federal court decided that there was a "high risk" Polanski would flee Switzerland if such a move went ahead, BBC News reports.
The controversial movie director remains in jail in the Central European country following his arrest there last month. He had been visiting Switzerland for a film festival.
Polanski was taken into custody in relation to a 1977 US conviction for unlawful sex with a 13-year-old girl. The filmmaker had fled to France before he could be sentenced over the matter.
In a statement today, the Federal Criminal Court of Switzerland said: "The court considered the risk that Roman Polanski might flee if released from custody as high."
Lawyers working for Polanski, who is currently awaiting extradition to the US, have now vowed to take the matter to Federal Supreme Court of Switzerland, which is the country's highest tribunal.
Legal representative Herve Temime said: "We will seek to demonstrate that there is no risk in ordering Roman Polanski's release."
