According to BBC News, the 41-year-old actor was stopped by police in the Leith area of Edinburgh in the early hours of this morning and went on to spend a night in the cells.
It is thought that officers were investigating reports of a vehicle striking a lamppost in the city.
Day, who is in Edinburgh for a starring role in the musical We Will Rock You, is now expected to appear at the city's Sheriff Court.
The father-of-two was previously charged with drink driving in July 2008. He later received a driving ban and was fined over the incident.
