Michael Davis Sapir, who once claimed to have had a "homosexual relationship" with the Top Gun star, has sued Cruise, his lawyer Bert Fields and private investigator Anthony Pellicano for $5 million (£3 million) for allegedly spying on him.
In 2001, Cruise sued Sapir for $100 million (£62 million) after he claimed to have a video proving his relationship with the Hollywood actor.
Sapir has accused Pellicano of illegally tapping his phone during the 2001 case, which was eventually settled out of court.
Bert Fields told TMZ that "the allegations are absolute garbage".
