According to TMZ, the organisation, which has been set up by the late actress's husband Simon Monjack and her mother Sharon Murphy, has never been registered as a charity with the US Internal Revenue Service (IRS) or the state of California.
The Foundation was allegedly set up for "charity dedicated to arts education for children."
By US law, as the Foundation is soliciting funds, it must disclose that it is not registered as a non-profit, which was missing from the official website this weekend. The website has since been taken down "for maintenance".
Monjack was unavailable for comment.
