Jesse James will face a difficult battle to win custody of his only daughter, according to a family law attorney.

The star's ex-wife Janine Lindemulder has reportedly begun legal proceedings to win back six-year-old daughter Sunny, after James was found to have cheated on his Oscar-winning wife Sandra Bullock.

The attorney Lisa Helfend Meyer told Fox News: "This definitely raises concerns about Jesse and how all of this could impact his parenting, whether he was spending enough time with his daughter and gives Janine a foot in the door to fight for custody.

"The court may appoint a minor counsel for the child and the judge would need to take a second look and see what is going on under the surface."

She added: "Sandra gave Jesse his stability and made him look like the stable one where Janine appeared to be instable (sic). But without Sandra, he looks flakey. The perfect picture is crumbling."
