Polanski's legal team last month cited judicial misconduct in the director's 1977 US trial as the basis for their plea.
The Second District Court of Appeal came to the decision just hours after denying a request by his victim to have the case dissolved.
Swiss authorities have revealed that they were awaiting on the decision by the court on Polanski's appeal before deciding whether to extradite him.
The award-winning helmer is currently under house arrest in Switzerland and faces a US arrest warrant for his conviction of unlawful sex with a 13-year-old girl.
The court has refused to comment on their decision.
