Matt Fiddes claims that The Jacksons Are Coming, which followed the famous family's search for a home in Devon, contained several staged scenes, according to Contactmusic.
Fiddes also claims that the 2008 Channel 4 show falsely implied he had betrayed Tito Jackson by leaking stories to the press. He is suing the station, production company Studio Lambert, and the programme's narrator Jane Preston.
The judge ruled there would be no jury when the case is head in London's High Court later this week as legal fees have already escalated to £3m.
Lawyers for Fiddes have now submitted an urgent appeal. "This is a classic case requiring trial by jury," his legal team stated.
