According to People, the pair, who confirmed their split in April, are seeking joint custody of their 3-year-old twins.
The singer has moved forward to end the union by filing a Petition for Dissolution of Domestic Partnership in Los Angeles on Friday, citing "irreconcilable differences".
In May, Michaels said that she was "sideswiped and left mangled" after her break-up with Etheridge.
The couple married in Malibu in September 2003.
