Birkhead testifies over Smith's drug use?

According to TMZ, Larry Birkhead is helping prosecutors in a case against Smith's doctors, who are accused of illegally supplying her with prescription pills. The star died of an accidental overdose in February 2007.
Legal documents claim that Birkhead has "personal knowledge of Anna Nicole Smith’s drug activities, gleaned from years of personal observation".
The father of Smith's 3-year-old daughter allegedly knows that Smith was an "addict" because he "personally observed her using controlled substances in an uncontrolled way over a long period of time".
Lawyers defending the doctors claim that Birkhead is not "qualified" to determine with Smith what could be legally classed as a drug addict.
