Mac died in August 2008 at the age of 50 due to complications from pneumonia.
McCullough's lawsuit claims that Mac's dermatologist Dr Rene M. Earles failed to recognise that he was in need of emergency treatment for respiratory failure and did not send the actor from his clinic to hospital in time, eventually leading to his death weeks later, Gossip Cop reports.
Mac also suffered from the lung disease sarcoidosis.
Earles told the Chicago Sun-Times that Mac appeared to be sick upon the visit in question, but he waited to consult with another one of Mac's doctors before sending him to hospital.
McCullough is suing Earles for $50,000 (£31,316).
