According to People, the Medium star filed for primary physical and legal custody of she and Jane's 7-year-old daughter Harlow and has also sought to deny Jane any spousal support.
Jane and Arquette first met in 2001 and were married in 2006 in Italy.
Despite an attempt to reconcile after a separation, the couple announced last week that they were divorcing after four years of marriage.
A rep for Jane said on Friday that they plan to keep their divorce proceedings amicable and asked that their privacy be respected.
