Miller decided to take legal action after the newspaper's private investigator Glenn Mulcaire allegedly hacked into her cell phone, acquiring her stored phone numbers as well as her account number and the pin for her voicemail, The Guardian reports.
The tabloid already faces similar lawsuits from celebrities such as Steve Coogan and Chris Tarrant.
Miller also sued the newspaper in 2008 for taking nude pictures of her on a closed set. That lawsuit was settled with an apology letter and damages.
