According to The AP, the pair legally split late last month.
Wahlberg and Fey both filed for divorce in August 2008 and reached a settlement in the case out of court.
They were married for eight years and have two sons together.
Wahlberg, the older brother of actor Mark, stars in the new CBS drama Blue Bloods.
