The pair were arrested in Canada last week after police learned of their several outstanding warrants issued in the US.
The warrants were issued after Quaid and his wife reportedly failed to appear at a court hearing for allegedly squatting in a house that they previously owned.
According to the Canada Border Services Agency, the Quaids will remain in detention despite earlier reports claiming that they were being released on bail, according to The Hollywood Reporter.
Evi reportedly told Canadian officials that the couple felt their lives were in danger and that they were seeking refuge status in the country.
"Randy has known eight close friends murdered in odd, strange manners. We feel that we're next," she said.
The immigration hearing is set for October 28.
