Joe Jackson's lawsuit concerning his son's passing will now be handled by a state court, reports The AP.
The federal judge told Joe's attorney that the late popstar's father would most likely not be able to collect the damages he is seeking as the singer's rights were not violated under the Americans with Disabilities Act, one of the major causes of the suit.
"I am firmly convinced that you can't seek damages on this (disabilities act) cause of action," said US District Judge John F. Walter.
He added: "This is a creature of state law, this wrongful death claim."
Joe's lawyer Brian Oxman plans to refile the case in Los Angeles Superior Court after dismissing the ADA-related claim in the lawsuit.
