According to The AP, LA Superior Court Judge Larry Paul Fidler cited insufficient evidence in his decision to dismiss felony burglary charges against Rachel Lee.
Lee stood accused of stealing items from Lohan's Hollywood Hills home in August 2009 but Fidler ruled that she could not be positively identified on security footage taken that night.
The judge indicated that prosecutors may be able to pursue a new case if they can prove that Lee accepted a coat stolen from Lohan's house during the incident.
"You have a nice receiving [charge]... You don't have a burglary," Fidler said.
Lee still faces a separate charge of burglary relating to a break-in at the home of Hills star Audrina Patridge.
