Although all charges by the Australian Crime Commission regarding the Crocodile Dundee actor's tax affairs have been dropped, the ATO reportedly still hope to take Hogan and his manager John Cornell to court for tax evasion.
Yasser El-Ansary, who is tax counsel for the Institute of Chartered Accountants, told the ABC: "They'll determine, I'm sure, over the coming weeks and potentially months, whether or not they feel they have a compelling enough case to prosecute and take this case to court.
"If the answer after that deliberative process is that they don't have enough information or they don't have enough evidence and they rate their chances of success as quite low, then I'm sure the ATO will face some questions around whether or not it should really proceed with this investigation or not."
Hogan's lawyer recently said that the tax fraud case could have been "handled differently".
