The actor - who began his sentence earlier this month - spent two years fighting his conviction, and has lost a previous appeal and a request for a retrial.
His lawyers have filed a new appeal to a Florida court, in the hopes of taking the case to the US Supreme Court, according to TMZ.
The team of lawyers are said to be requesting bail for the Blade star, followed by a new trial, following reports of alleged jury misconduct in the previous case in 2008.
