The Entourage star was driving in Los Angeles and being interviewed over the phone for 2Day FM's Kyle & Jackie O Show.
A Beverly Hills Police officer pulled the actor over and cited him a fine.
"You know what, I apologise, it's a work related call and it's not even a good excuse. But I had to pick it up because it's a radio station who's calling," Piven told the officer.
According to TMZ the radio station offered to pay the fine.
Piven, who was previously rumoured to replace Charlie Sheen in Two and a Half Men, has signed on to reprise the role of Ari Gold in the final season of Entourage, premiering July 24 at 9.30pm ET on HBO.
