In late April, Judge Stephanie Sautner ruled to reduce the offence, which stems from the alleged theft of a $2,500 (£1,500) necklace, to a misdemeanor because Lohan's prior record didn't warrant felony proceeding.
Sandi Gibbons, a spokesperson for the LA District Attorney's office, has now confirmed that the judge's ruling takes the case out of the DA's jurisdiction.
"Because the charge was reduced by the court to a misdemeanor, the district attorney no longer has jurisdiction to prosecute the case and, therefore, we will give the case to the City Attorney's Office," Gibbons noted.
While the case is due to be handed over today, the LA City Attorney's office's own spokesperson Frank Mateljan told E! News that the move was expected, but added that the case history had yet not arrived from the DA.
It was previously reported that Lohan might not face any more jail time in her separate probation violation proceedings now that her theft charge has been lessened.
The actress was sentenced to 120 days behind bars and 480 hours of community service last month during a preliminary court hearing for violating the terms of her probation by allegedly stealing the necklace from LA boutique Kamofie & Company.
She was released on bail after being jailed for five hours and is due to begin her community service requirements this week at the LA County Morgue and the Downtown Women's Centre.
During an appearance on The Tonight Show with Jay Leno last week, Lohan admitted that she's "made a lot of poor decisions" in recent years, but affirmed that she's begun to turn her life around.
