Richard A Franco has been charged with two counts of felony burglary and stalking for trying to illegally enter Berry's home three times in July.
Berry was granted a permanent restraining order against Franco, which prevents him from coming within 100 yards of the star.
An LA Superior Court judge ruled this week that Franco is fit to face a trial after hearing testimony from the police detective who helped apprehend the man.
Detective John Gregozek testified that Franco was able to steal a key to Berry's home by entering a door which had accidentally been left open on July 10, reports The AP.
Franco was only arrested after Berry spotted him on her property and immediately called the police. Law enforcement later found a notebook, which contained notes about Berry, in Franco's possession following the arrest, according to the actress's private security guard.
Franco will be arraigned on October 31 and is to be held on $150,000 (£94,930) bail at least until that date. He has pleaded not guilty to all charges.
Berry will next co-star with Robert De Niro and Jessica Biel in New Year's Eve, which opens on December 9 in the US and the UK.
