Halle Berry ex Gabriel Aubry won't be charged for assault

The 36-year-old model and father of Berry's daughter Nahla was reported to have shoved a nanny while she was holding the child last month.
The incident arose when the nanny confronted Aubry about failing to take Nahla to school one day. According to an official report, Aubry became angry and pushed the nanny out of the door.
LA City Attorney representative Frank Mateljan has told TMZ that Aubry will not be charged for assault due to "insufficient evidence".
However, a court judge has placed an order that says Aubry can only watch Nahla under supervision from the state.
Gabriel Aubry and Halle Berry split in April 2010. Aubry filed paternity claims in December 2010 to establish custody of Nahla.
Since then, Halle Berry has been involved with French actor Olivier Martinez.
